Mediation is widely recognized around the world as an effective Alternative Dispute Resolution (ADR) method for resolving conflicts without resorting to litigation. While its core principle remains consistent—engaging a neutral third party to facilitate a mutually acceptable agreement—the application of mediation varies across jurisdictions and sectors.
Construction disputes are often unavoidable due to the complex nature of contracts, project timelines, technical specifications, and financial arrangements. Recognizing this, the Construction Industry Development Act No. 33 of 2014 (Clause 50) empowers the Construction Industry Development Authority (CIDA) to establish a structured mediation framework to address disputes within the industry.
